AI Regulation: Implications of the EU AI Act for UK Businesses

This is the second in a 3-part mini-series on AI regulation and what it means to UK businesses - large and small. The first article AI Regulation: Navigating UK Compliance provided an overview of the UK regulatory requirements with respect to AI and this second article looks at the European regulatory compliance factors and specifically the EU AI Act and how it impacts UK businesses - even when they only operate from within the UK. Introduction

The EU's regulatory landscape continues to have a profound impact on UK businesses, particularly in the rapidly evolving field of Artificial Intelligence (AI). The EU AI Act is a landmark piece of legislation that aims to ensure the development and deployment of trustworthy AI systems. The act came into force in June 2024 with further milestones for adoption including the ban of AI systems posing an unacceptable risk to EU citizens from February this year. This regulation sets out specific rules for AI systems, and UK organisations that operate within or trade with the EU must understand and adhere to its implications to maintain access to this crucial market. This article provides an outline of the EU AI Act and what it means for your business.

Understanding the EU AI Act

The EU AI Act takes a risk-based approach to regulating AI systems, recognising that different AI applications pose varying levels of potential harm. This approach categorises AI systems into different risk levels and imposes corresponding requirements:

  • Unacceptable Risk AI: AI systems considered to pose an unacceptable risk to fundamental rights are strictly prohibited.  This ban came into effect on 2nd February 2025. Examples include AI systems that manipulate human behaviour to circumvent free will, social scoring systems that classify individuals based on their social behaviour or personal characteristics, and certain applications of real-time remote biometric identification systems in publicly accessible spaces (with limited exceptions for law enforcement purposes).    

  • High-Risk AI: AI systems identified as high-risk are those that could pose significant harm to people's health, safety, or fundamental rights.  These systems are subject to stringent requirements before they can be placed on the EU market.  Examples include AI used in:

    • Critical infrastructure (e.g., energy, transport)

    • Education

    • Employment (e.g., recruitment)

    • Essential private and public services (e.g., healthcare, banking)

    • Law enforcement

    • Migration and border control

    • Justice (e.g., influencing court decisions)   

  • Limited Risk AI: AI systems in this category are subject to lighter transparency obligations.  For instance, users should be informed when they are interacting with an AI system, such as a chatbot.   

  • Minimal Risk AI: The vast majority of AI systems fall into this category, which includes applications like AI-enabled video games or spam filters.  These systems are subject to minimal or no specific legal obligations under the AI Act.   


Why UK Businesses Need to Pay Attention:

The EU AI Act has extraterritorial reach, meaning it applies to organisations outside the EU if their AI systems affect EU citizens or are used within the EU. This has several implications for UK businesses:  

  • Market Access: If your UK business develops, deploys, or sells AI systems that are used within the EU or affect EU citizens, you must comply with the AI Act's requirements to access the EU market.    

  • Global Influence: The EU AI Act is poised to become a global benchmark for AI regulation.  Even if your primary market is not the EU, adhering to its principles can enhance your organisation's reputation and prepare you for future regulatory trends.   

  • Building Trust: Demonstrating a commitment to responsible AI practices and complying with the AI Act can significantly enhance your organisation's reputation and build trust with customers, partners, and stakeholders, both within and outside the EU.

  • Risk Management Systems: The EU AI Act mandates that providers and deployers of high-risk AI systems establish and maintain a robust risk management system throughout the AI system’s lifecycle.  This system should:

    • Identify and analyse known and reasonably foreseeable risks.

    • Assess the probability and severity of potential risks.

    • Evaluate risks when the AI system is used in accordance with its intended purpose and under conditions of reasonably foreseeable misuse.   

    • Adopt appropriate risk management measures.

    • Monitor the effectiveness of risk management measures.

  • Data Governance: High-quality data is paramount for AI systems to function accurately and avoid bias.  The AI Act places significant emphasis on data governance, requiring that the data used for training, validation, and testing high-risk AI systems must meet specific quality criteria.  This includes ensuring that the data is:

    • Relevant and representative of the intended use case.

    • Free from errors, biases, and limitations.

    • Sufficiently robust and statistically appropriate.

  • Transparency and Explainability: The EU AI Act prioritises transparency, requiring that users are provided with clear and understandable information about high-risk AI systems.  In some cases, explainability is also crucial, meaning the ability to understand and explain the AI system’s decision-making process.  This is particularly important in situations where AI decisions can significantly impact individuals' lives.   

  • Human Oversight: To ensure that high-risk AI systems remain under appropriate human control, the AI Act mandates the implementation of human oversight mechanisms.  This involves establishing measures that allow appropriately trained persons to:

    • Monitor the AI system’s operation.

    • Intervene or override the AI system’s decisions when necessary.
